Virtual Office Website (VOW) Terms of Use

By registering for and using this VOW Portal provided by The Agency Sun Valley ("Brokerage"), you ("Registrant") agree to the following terms and conditions:

1. Purpose & Personal Use

The MLS listing data accessible through this portal is provided exclusively for your personal, non-commercial use. You may use this data to identify properties you may wish to investigate further, for valuation purposes, or for other personal real estate purposes.

2. Prohibited Uses

You agree that you will NOT:

• Copy, redistribute, retransmit, or make available to any other person or entity any MLS listing data
• Use the data for any commercial purpose, including but not limited to resale, licensing, or any form of data mining or scraping
• Use any automated systems, bots, spiders, or scrapers to access the portal or collect data
• Attempt to bypass security measures or access controls
• Display or distribute data in a manner inconsistent with MLS rules and regulations

3. Data Ownership & Accuracy

All MLS listing data remains the property of the Sun Valley Board of REALTORS® (SVBOR) MLS. The data is deemed reliable but not guaranteed. You should independently verify all information before making real estate decisions.

4. Account & Access

• Your account is personal and may not be shared with others
• Your login credentials are unique to you and must be kept confidential
• The Brokerage reserves the right to revoke access at any time for violations of these terms
• Your registration information may be provided to the MLS upon request for compliance purposes

5. Monitoring & Compliance

Your use of this portal may be monitored to ensure compliance with these terms, MLS rules, and applicable laws. The Brokerage maintains records of all registrant activity for a minimum of 180 days past account expiration, as required by MLS regulations.

6. Sold/Closed Data (VOW Access)

As a registered VOW user, you may have access to sold/closed listing data. This data is subject to the same restrictions above and may only be used for personal property valuation and research purposes. Display of sold data is subject to any seller opt-out elections on file with the MLS.

7. Seller Opt-Outs

Certain sellers have elected to opt out of having their listing information displayed on the internet. These listings will not be shown on this portal in compliance with MLS rules and seller rights.

8. Termination

Either party may terminate this agreement at any time. Upon termination, you must cease use of any MLS data obtained through the portal. The Brokerage will retain your registration records for 180 days following termination, as required by MLS regulations.

9. Spark Platform Consumer Terms of Use

This portal accesses MLS data through the Spark® Platform operated by Financial Business Systems, Inc. (FBS). Your access to and use of MLS data through this portal is also subject to the Spark Platform Consumer Terms of Use, which apply in addition to the terms above. By registering, you acknowledge that you have had the opportunity to review those terms and agree to be bound by them.

10. Usage Analytics & Market Intelligence

What we collect. REVx logs anonymized events about how you use the platform: pages viewed, searches performed (as hashed values, not plaintext), filters applied, CMAs run, reports exported, properties saved, and similar interactions. Each event is associated with your account ID and a per-session identifier. We do not log mouse movement, keystrokes outside of form submissions, or browser content outside of REVx.

What we never collect. We do not store plaintext search queries, client names, client contact information, or private notes. We do not track your activity on other websites.

How we use it. We use this data to (a) improve the REVx product by identifying which features help agents and which don’t, (b) detect and respond to bugs and abuse, and (c) produce aggregated market-intelligence reports about Wood River Valley real estate activity.

Aggregate publication and sale. We may publish or sell aggregated, anonymized market-activity reports based on this usage data — for example, reports describing weekly or monthly patterns of listing interest, price-band activity, or sub-market attention across the Wood River Valley. “Aggregated” means no report will contain any metric derived from fewer than five underlying users, to prevent re-identification. We will never sell or share raw event data, individual-agent performance data, or any data that identifies a specific user or client.

Your rights. You may request a copy of your event history or request deletion of your account and associated event data at any time by emailing info@revxtours.com. We will respond within 30 days.

Changes. If we ever materially change this policy — for example, if we decided to sell non-aggregated data in the future — we will notify you by email at least 30 days in advance, and you will have the opportunity to delete your account before the change takes effect.
